On peut s\u2019interroger sur l\u2019impact fiscal d\u2019une telle op\u00e9ration dans le calcul de l\u2019imp\u00f4t sur le revenu, tant pour le financement de la r\u00e9sidence principale, que pour les logements donn\u00e9s en location nue.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\"><strong><span style=\"text-decoration: underline\">Pour la r\u00e9sidence principale :<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Depuis le mois de Mai 2007, les particuliers domicili\u00e9s en France, finan\u00e7ant \u00e0 cr\u00e9dit l\u2019acquisition de leurs r\u00e9sidences principales aupr\u00e8s d\u2019une banque de l\u2019Union Europ\u00e9enne, b\u00e9n\u00e9ficient d\u2019un cr\u00e9dit d\u2019imp\u00f4t sur le revenu.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Pour un frontalier genevois, ne payant pas d\u2019imp\u00f4t en France, l\u2019administration fiscale lui adresse un ch\u00e8que du montant du cr\u00e9dit d\u2019imp\u00f4t.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Les int\u00e9r\u00eats pris en compte sont ceux pay\u00e9s annuellement au titre des cinq premi\u00e8res ann\u00e9es de remboursement du cr\u00e9dit \u00e9ligible, dans la limite de \u20ac 3&#8217;750.- pour un c\u00e9libataire et \u20ac 7&#8217;500.- pour un couple mari\u00e9 (montant doubl\u00e9 en pr\u00e9sence d\u2019une personne handicap\u00e9e et major\u00e9e de \u20ac 500.- par personne \u00e0 charge).<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">L\u2019administration fiscale a confirm\u00e9 r\u00e9cemment qu\u2019il est possible de prendre fiscalement en compte les int\u00e9r\u00eats de l\u2019emprunt substitutif pour l\u2019application du cr\u00e9dit d\u2019imp\u00f4t, dans la limite de ceux figurant dans le tableau d\u2019amortissement initial. Les \u00e9ventuels frais g\u00e9n\u00e9r\u00e9s par la ren\u00e9gociation ne pourront \u00eatre pris en compte.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\"text-decoration: underline\">En r\u00e9sum\u00e9 :<\/span><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-size: small\"> Il est possible de prendre en compte fiscalement les int\u00e9r\u00eats de l\u2019emprunt substitutif pour l\u2019application du cr\u00e9dit d\u2019imp\u00f4t dans la limite de ceux figurant dans le tableau d\u2019amortissement initial.<\/span><\/li>\n<li><span style=\"font-size: small\">Il n\u2019est pas possible de profiter de la ren\u00e9gociation du cr\u00e9dit pour amplifier les effets fiscaux du cr\u00e9dit d\u2019imp\u00f4t.<\/span><\/li>\n<li><span style=\"font-size: small\">Les frais g\u00e9n\u00e9r\u00e9s par la ren\u00e9gociation du cr\u00e9dit (p\u00e9nalit\u00e9, frais de dossier&#8230;)ne peuvent pas \u00eatre pris en compte.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\">\u00a0<\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Le cr\u00e9dit d\u2019imp\u00f4t pour la r\u00e9sidence principale tombera au 1er Janvier 2011.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Le projet de loi de finance indique que le b\u00e9n\u00e9fice du cr\u00e9dit d\u2019imp\u00f4t s\u2019applique aux op\u00e9rations pour lesquelles une offre de pr\u00eat a \u00e9t\u00e9 \u00e9mise avant le 1er janvier 2011, sous r\u00e9serve que l\u2019acquisition du logement s\u2019ach\u00e8ve au plus tard le 30 Septembre 2011.<\/span><\/p>\n<p style=\"text-align: justify\">\u00a0<\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\"><strong><span style=\"text-decoration: underline\">Concernant la location de logements nus :<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Seuls sont concern\u00e9s les contribuables impos\u00e9s sous le r\u00e9gime \u00ab r\u00e9el \u00bb d\u2019imposition, ceux ayant opt\u00e9 pour le r\u00e9gime \u00ab micro-foncier \u00bb n\u2019\u00e9tant pas concern\u00e9s.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">L\u2019article 31 du CGI autorise notamment la d\u00e9duction des int\u00e9r\u00eats de dettes contract\u00e9es pour la conservation, l\u2019acquisition, la construction, la r\u00e9paration ou l\u2019am\u00e9lioration de la propri\u00e9t\u00e9.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">En plus des int\u00e9r\u00eats d\u2019emprunts, l\u2019administration fiscale consid\u00e8re que les frais d\u2019emprunt (frais de dossier, primes aff\u00e9rentes \u00e0 l\u2019assurance d\u00e9c\u00e8s invalidit\u00e9 pour garantir l\u2019emprunt\u2026.) sont consid\u00e9r\u00e9s comme des charges d\u00e9ductibles au m\u00eame titre que les int\u00e9r\u00eats d\u2019emprunt dont ils d\u00e9coulent.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: small\">Dans ce cas aussi, l\u2019administration fiscale admet la d\u00e9ductibilit\u00e9 des int\u00e9r\u00eats des emprunts substitutifs, dans la limite de ceux figurant dans l\u2019\u00e9ch\u00e9ancier initial.<\/span><\/p>\n<p style=\"text-align: justify\">\u00a0<\/p>\n<p style=\"text-align: justify\">\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0 Avec la forte baisse des taux d\u2019int\u00e9r\u00eats, bon nombre de frontaliers profitent de l\u2019occasion pour ren\u00e9gocier les conditions de leurs cr\u00e9dits immobiliers.
